Terms of Service

1. Acceptance of Terms

By accessing or using BirdTracks (available at birdtracks.io), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the service. BirdTracks is operated by BirdTracks LLC.

2. Description of Service

BirdTracks is a cloud-based bird breeding management software platform. The service allows breeders to track birds, manage breeding pairs, monitor clutches and hatch schedules, calculate genetics and coefficients of inbreeding, generate pedigrees, and organize aviary operations. Features and functionality may change over time as we continue to develop and improve the platform.

3. Account Registration

To use BirdTracks, you must create an account by providing a valid email address. Phone number verification may also be required. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must provide accurate and complete information during registration and keep your account information up to date.

4. Subscription and Payment

BirdTracks offers a free tier and paid subscription plans. Paid subscriptions are billed through our payment processor. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis. You may cancel your subscription at any time, and cancellation will take effect at the end of the current billing period. Free trial periods may be offered at our discretion. BirdTracks reserves the right to modify pricing, plan features, trial durations, and billing terms at any time. Changes to pricing will apply to new billing cycles; existing prepaid periods will be honored.

5. User Data and Content

You retain ownership of all data and content you enter into BirdTracks, including bird records, breeding data, photos, and notes. By using the service, you grant us a limited license to store, process, and display your data solely for the purpose of providing the service to you. We do not claim ownership over your content.

6. Data Retention

All data entered into BirdTracks is retained indefinitely, even if you delete records from your view within the application. Deleted records may be soft-deleted or archived rather than permanently removed from our systems. This practice ensures data integrity, supports audit trails, and allows for compliance with applicable regulations. If you close your account, your data may continue to be stored in our systems in accordance with our data retention practices.

7. Acceptable Use

You agree not to:

• Reverse engineer, decompile, or disassemble any part of the BirdTracks software
• Copy, scrape, or reproduce the application, its design, or its content by any means
• Use automated tools, bots, or scripts to access or interact with the service without prior written consent
• Use the service for any unlawful purpose or in violation of any applicable laws
• Attempt to gain unauthorized access to other users' accounts or our systems
• Interfere with or disrupt the integrity or performance of the service
• Create multiple accounts to circumvent trial limits or subscription restrictions
• Use automated tools to scrape, download, or bulk-export content from the service
• Attempt to access, view, or modify other users' data
• Share login credentials with other individuals or entities
• Use the service, its data, or its design to build a competing product or service

8. Intellectual Property

The BirdTracks software, including but not limited to its source code, algorithms (including the genetics prediction engine, COI calculator, and pairing recommendation system), user interface design, database schema, and all associated documentation, is the exclusive intellectual property of BirdTracks. All rights are reserved. Any attempt to reverse engineer, decompile, copy, scrape, or reproduce any portion of the software is strictly prohibited and may result in immediate account termination and legal action. Nothing in these terms grants you any right to use our trademarks, logos, or branding without express written permission.

9. Account Suspension and Termination

BirdTracks reserves the right to suspend, restrict, or terminate any account at any time, for any reason, with or without notice, including but not limited to violations of these terms, suspected fraud, abuse, or at our sole discretion. This applies to both free and paid accounts. No refunds will be issued for suspended paid accounts unless required by applicable law.

10. Data Collection and Monitoring

By using BirdTracks, you consent to the collection and processing of usage data including but not limited to: IP addresses, device information, browser type, pages visited, session recordings (via third-party analytics tools), click patterns, and interaction data. This data is used to improve the service, detect fraud, prevent abuse, and ensure platform security.

11. Session Recording Consent

BirdTracks uses session recording and analytics tools to understand how users interact with the service. These tools may record mouse movements, clicks, scrolls, and page content during your session. By using BirdTracks, you consent to this recording. No sensitive personal data (passwords, payment card numbers) is captured by these tools.

12. IP Address Logging

We log IP addresses associated with account activity, including login events, for the purposes of security monitoring, fraud prevention, and abuse detection. This information may be retained and used to investigate suspicious activity or enforce these terms.

13. Termination

You may terminate your account at any time by contacting us. We may terminate or suspend your account if you violate these terms or for any other reason at our discretion, with or without notice. Upon termination, your right to use the service ceases immediately. Provisions that by their nature should survive termination (including data retention, intellectual property, limitation of liability, and governing law) will remain in effect.

14. Limitation of Liability

BirdTracks and BirdTracks are provided "as is" and "as available" without warranties of any kind, whether express or implied. To the fullest extent permitted by law, BirdTracks shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or revenue, arising out of or related to your use of the service. Our total liability for any claim arising under these terms shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

15. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the State of Florida, United States of America, without regard to conflict of law principles. Any disputes arising from these terms or your use of the service shall be resolved in the courts located in the State of Florida.

16. Changes to Terms

We may update these Terms of Service from time to time. When we make changes, we will update the "Last updated" date at the top of this page. Your continued use of BirdTracks after changes are posted constitutes your acceptance of the revised terms. We encourage you to review this page periodically.
