Terms of Service

1. Acceptance of Terms

By accessing or using BirdTracks (available at birdtracks.io), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the service. BirdTracks is operated by Pro Specialty Services.

2. Description of Service

BirdTracks is a cloud-based bird breeding management software platform. The service allows breeders to track birds, manage breeding pairs, monitor clutches and hatch schedules, calculate genetics and coefficients of inbreeding, generate pedigrees, and organize aviary operations. Features and functionality may change over time as we continue to develop and improve the platform.

3. Account Registration

To use BirdTracks, you must create an account by providing a valid email address. Phone number verification may also be required. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must provide accurate and complete information during registration and keep your account information up to date.

4. Subscription and Payment

BirdTracks offers a free tier and paid subscription plans. Paid subscriptions are billed through Stripe. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis. You may cancel your subscription at any time, and cancellation will take effect at the end of the current billing period. Free trial periods may be offered at our discretion, and we reserve the right to modify pricing or plan features with reasonable notice.

5. User Data and Content

You retain ownership of all data and content you enter into BirdTracks, including bird records, breeding data, photos, and notes. By using the service, you grant us a limited license to store, process, and display your data solely for the purpose of providing the service to you. We do not claim ownership over your content.

6. Data Retention

All data entered into BirdTracks is retained indefinitely, even if you delete records from your view within the application. Deleted records may be soft-deleted or archived rather than permanently removed from our systems. This practice ensures data integrity, supports audit trails, and allows for compliance with applicable regulations. If you close your account, your data may continue to be stored in our systems in accordance with our data retention practices.

7. Acceptable Use

You agree not to:

• Reverse engineer, decompile, or disassemble any part of the BirdTracks software
• Copy, scrape, or reproduce the application, its design, or its content by any means
• Use automated tools, bots, or scripts to access or interact with the service without prior written consent
• Use the service for any unlawful purpose or in violation of any applicable laws
• Attempt to gain unauthorized access to other users' accounts or our systems
• Interfere with or disrupt the integrity or performance of the service

8. Intellectual Property

The BirdTracks software, including its source code, design, user interface, algorithms, genetics engine, coefficient of inbreeding (COI) calculator, and all related intellectual property, is the exclusive property of Pro Specialty Services. All rights are reserved. Nothing in these terms grants you any right to use our trademarks, logos, or branding without express written permission.

9. Account Suspension

We reserve the right to suspend or restrict access to any account that we reasonably believe is in violation of these Terms of Service, is being used fraudulently, or is negatively impacting the service for other users. We will make reasonable efforts to notify you before or promptly after any suspension, unless doing so would compromise security or legal obligations.

10. IP Address Logging

We log IP addresses associated with account activity, including login events, for the purposes of security monitoring, fraud prevention, and abuse detection. This information may be retained and used to investigate suspicious activity or enforce these terms.

11. Termination

You may terminate your account at any time by contacting us. We may terminate or suspend your account if you violate these terms or for any other reason at our discretion, with or without notice. Upon termination, your right to use the service ceases immediately. Provisions that by their nature should survive termination (including data retention, intellectual property, limitation of liability, and governing law) will remain in effect.

12. Limitation of Liability

BirdTracks and Pro Specialty Services are provided "as is" and "as available" without warranties of any kind, whether express or implied. To the fullest extent permitted by law, Pro Specialty Services shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or revenue, arising out of or related to your use of the service. Our total liability for any claim arising under these terms shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

13. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the State of Texas, United States of America, without regard to conflict of law principles. Any disputes arising from these terms or your use of the service shall be resolved in the courts located in the State of Texas.

14. Changes to Terms

We may update these Terms of Service from time to time. When we make changes, we will update the "Last updated" date at the top of this page. Your continued use of BirdTracks after changes are posted constitutes your acceptance of the revised terms. We encourage you to review this page periodically.
